Texas Expandable Baton Use When Walking My Dog.

I walk my smaller dog i have my expandble baton with me, mostly for fear of larger dogs attacking my smaler dog. Is this legal? I live near Houston Texas.


Hi Kenneth,

I highly suggest speaking with local law enforcement on this. As I interpret your law, it is NOT legal to carry the baton. This is surprising to me, but I would not think it is worth carrying as it is a Class A misdemeanor or even a Felony in some situations.

There is only one legal way to defend yourself against aggressive dogs as far as I know. While protecting yourself for self defense, anything goes, there is a better way that will keep you and your puppy safe.

Texas Expandable Baton Laws

§ 46.01. DEFINITIONS. In this chapter:
(1) "Club" means an instrument that is specially designed, made, or adapted for the purpose of inflicting serious bodily injury or death by striking a person with the instrument, and includes but is not limited to the following:
(A) blackjack;
(B) nightstick;
(C) mace;
(D) tomahawk.
§ 46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits an offense if he intentionally, knowingly, or recklessly carries on or about his person a handgun, illegal knife, or club. (b) Except as provided by Subsection (c), an offense under this section is a Class A misdemeanor. (c) An offense under this section is a felony of the third degree if the offense is committed on any premises licensed or issued a permit by this state for the sale of alcoholic beverages.
